Terms of Service

1. Acceptance of terms

By accessing or using Capgrown, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service. These terms form a binding legal agreement between you and InfusEDU.

2. Who may use the service

You must be at least 13 years old to use Capgrown. If you are under 18, you represent that you have parental or guardian consent. If you are using Capgrown on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated.

4. Acceptable use

You agree not to misuse the service. Prohibited conduct includes:

  • Unlawful use or violating any applicable laws or regulations.
  • Fraud, spam, or phishing.
  • Infringing intellectual property rights or distributing malware.
  • Interfering with platform security, probing, scraping, or reverse engineering.
  • Using AI-generated outputs for illegal purposes, creating deepfakes, hate speech, or attempting to jailbreak AI systems.
  • Circumventing usage limits, subscription tiers, or technical restrictions.

5. Intellectual property

InfusEDU retains all rights to the Capgrown platform, software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within the scope of your selected plan. You retain ownership of content you input, and you grant us a limited license to host and process it solely to provide the service.

6. AI-generated content

Capgrown uses artificial intelligence to generate guidance, suggestions, and comparisons. You acknowledge that:

  • AI outputs may contain errors or inaccuracies and should not be treated as professional financial, legal, or tax advice.
  • You are responsible for your prompts, how you use outputs, and verifying the accuracy of any information before acting on it.
  • You must have the rights to any content you input into the platform.
  • We reserve the right to moderate content, refuse or filter outputs, and suspend accounts for repeated misuse.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically unless cancelled. You may cancel at any time through your account or by contacting Paddle.

8. Service level

We do not guarantee uninterrupted or error-free performance. The service is provided "as is" without warranties of any kind, to the fullest extent permitted by law.

9. Termination and suspension

We may suspend or terminate your access for: material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the service ends immediately. We will provide a reasonable opportunity to export your data where feasible.

10. Limitation of liability

To the maximum extent permitted by law, InfusEDU's aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill, except where prohibited by law.

11. Indemnity

You agree to indemnify and hold harmless InfusEDU from claims arising out of your content, unlawful use of the service, or violation of these terms.

12. Governing law

These terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Maryland.

13. Changes to these terms

We may update these terms from time to time. Material changes will be notified by email or through the platform. Continued use after changes constitutes acceptance.
